Terms and Conditions of Business for personal Design and Dressmaking services.

Design and Dressmaking services provides a service making bespoke garments to your agreed specifications in shape and fabrics. You are contracting with us for our services.

The initial consultation is free of charge and there is no obligation on you to commission any work.

Commissioning work:
• We have no obligation to commerce work on any item discussed until we receive from you a signed copy of this document together with the requested deposit payment.
• Payment of the deposit will confirm your acceptance of these Terms and Conditions.
Quotations:
• Information agreed at the time of quotation is the sole basis for the cost. This quotation is subject to change if there are any omissions or additions to the original design.
Completion:
• Work will aim to be complete one week prior to requirement provided this is agreed at the consultation stage.
• Both parties in terms of time and place will agree all fitting appointments.
• We shall not be responsible for any default to any act of God or other event beyond our reasonable control.
• Acceptance of urgent work is at our discretion and will attract a premium charge.

Cancellation fees:
* Cancellation of an order following payment of deposits will incur loss of deposits.

Measurements:
• We will take complete sets of measurements at a time that is agreed with you in respect of any weight loss plan, pregnancy, illness/ recovery factor. It is important that this is made known at the point of order.
Appointments and Fittings:
We see clients by appointment only
A Toile fitting will be provided allowing each garment to be worn, agreed for style and design and adjusted to individual measurements prior to the actual fabric being cut.
• You must bring with you to all fitting appointments the underwear and shoes you will wear with the completed garments. The fitting cannot proceed otherwise and will be charged at a premium rate.
• Most appointments will last less than an hour, however, timing depends on amount of persons and garments being fitted.
• Please telephone at least 24 hours in advance if you need to rearrange.
• Missed appointments will incur costs at premium rates.

Design and fabrics:
• All designs are provided by us and are our property.
• Fabric samples will be provided following initial consultations and will be agreed by you before ordering. Fabrics will be chosen as suitable for the design chosen.
Collection and payment:
• Payment in full is required before the garments are collected or dispatched
• Payment is accepted by the following methods: Cash or Bank Transfer

Upon collection or delivery, you should confirm that the garment(s) are as ordered and sign the acceptance thereof. If for any reason you are unable to sign on delivery or uplift you must notify us within three days of any comment in connection with the order, or it shall be deemed that the garments have been accepted. All other warranties, whether expressed or implied, by statute or otherwise are excluded to the fullest extent permitted by law.

In the event of any breach of contract, your remedies shall be limited to damages and the quantum of damages for any breach shall be limited to the price of the garment(s) made by me and, if not included in the price, the cost of reasonably equivalent materials (excluding delivery charges).

Such contract between us shall be treated as though it were executed and performed in the United Kingdom and shall be governed by and construed in accordance with the laws of the United Kingdom. Any cause of action of the customer with respect to services ordered from A Scottish Touch must be instituted within six months after any purchase or be forever waived and barred. All actions shall be subject to the limitations set forth in the terms and conditions as provided in this document. The language used herein shall be interpreted as to its fair meaning and not strictly for or against any party. All legal proceedings arising out of or in connection with this Contract shall be brought solely in the United Kingdom and the Customer expressly submits to the jurisdiction of said courts and the Customer consents to extra-territorial service of process. Shall any part of this contract be held invalid or unenforceable, that portion shall be construed consistent with applicable law as nearly as possible to reflect the original intentions of the parties and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with A Scottish Touch is in conflict or inconsistent with this Contract, this Contract shall take precedence and any representations which may have been made explicitly do not form a part of the contract not have they induced you to enter it. Failure of A Scottish Touch to enforce any provision nor of the right to enforce such a provision. Nothing in this contract should be deemed to remove any of your statutory rights as a consumer.
